The City of Los Angeles barely makes the grade in its anti-tobacco efforts according to the latest “State of Tobacco Control” report released by the American Lung Association (ALA). The annual report, now in its 15thyear, provides assessments of tobacco reduction efforts at the city, state, and federal levels.

While Los Angeles received an overall passing grade “C” for its tobacco control legislated policies, the city received its highest marks (an “A”) for its work on reducing sales of tobacco to youth but received its lowest marks (an “F”) on smoke-free housing. The low ranking score for smoke-free housing is consistent with research findings by the   (Center) showing that nearly 80 percent of Los Angeles apartments are not protected by nonsmoking provisions.

“This report confirms what we have seen in our work with the Los Angeles tenant and landlord communities. The current rental market in Los Angeles does not provide nearly enough protections for its residents against secondhand smoke where they live,” said Peggy Toy, Director of the Center’s UCLA-SAFE REACH Project. “Furthermore, studies have shown this issue disproportionately affects those living in low income communities, where residential tobacco use is more prevalent.”

Exposure to secondhand smoke (SHS) remains a major public health issue. According to the Centers for Disease Control and Prevention (CDC), an estimated 41,000 nonsmoking adults die as a result of SHS every year. CDC statistics also show that nationwide more than one in three nonsmoking renters are exposed to SHS.

American Lung Association National President and CEO Harold P. Wimmer reinforced secondhand smoke as a public health priority in comments made in conjunction with the report’s release. “In 2022, the American Lung Association will be working to defend the gains that have been made to combat tobacco use and we will push federal and state leaders to summon the courage to enact policies that will save lives – funding tobacco prevention programs, helping smokers quit and protecting everyone from secondhand smoke,” Wimmer said.

Residents of Los Angeles are protected against second-hand smoke exposure in the workplace and at many public places. However, there is no guaranteed legal protection that safeguards residents of multi-unit housing from breathing unwanted smoke in their own homes.

Exposure to second-hand smoke is an acknowledged nuisance, but more importantly, it is a health hazard, and also carries costs associated with smoke damage as well as increased risk of fire. Allowing smoking in apartment complexes creates issues and added costs for property owners, as well as potentially harming the health, safety and comfort of residents.

A study conducted by the UCLA Center for Health Policy Research in 2022 determined that only 20 percent of apartments in Los Angeles have a smoke-free policy. The same study found that 82 percent of apartment residents say that they are in support of smoke-free policies, including people who smoke.

In the absence of a citywide ordinance, the responsibility for providing these types of protections falls upon landlords, who have the full legal right to impose and enforce smoke-free policies at their properties, but who are sometimes hesitant about doing so out of fear of pushback from tenants and potential loss of income.

However, through our experience at FAME Corporations, we have found that the benefits far outweigh the risks in adopting a smoke-free policy, and when done properly, can enhance landlord-tenant relations, create a greater sense of harmony and community and save money. Moving towards smoke-free housing is not only a worthy investment, but can also be a win-win in terms of tenant relations.

On Jan. 1, FAME Corporations adopted a smoke-free policy across our 12 affordable apartment complexes is South Los Angeles. The policy required all indoor and outdoor common areas, including entrances, lobbies, open spaces and play areas, as well as 100 percent of connecting individual units (including balcony and patio areas) to be designated as smoke free. The policy was implemented as a lease addendum, prohibiting smoking of all tobacco products, marijuana and e-cigarettes.

FAME’s primary interest in implementing the policy was out of concern for tenant’s welfare, and to create a healthy home environment for our residents. Exposure to second-hand smoke can cause serious health problems and a reduced quality of life.

Young children are at a higher risk because their bodies are still growing and they breathe at a faster rate than adults. Kids exposed to second-hand smoke are at a greater risk for asthma attacks and respiratory infections such as bronchitis and pneumonia.

The process to introduce and adopt the policy took place over more than a year. We were able, through supportive funding provided by the California Tobacco Control Program, to conduct community education presentations, public opinion polls and tenant focus groups to fully understand our residents’ beliefs and concerns about adopting a smoke-free housing policy.

After surveying more than 100 residents, 66 percent were in favor of implementing a smoke-free policy to protect the health of their families. We also recruited tenant liaisons to speak to their neighbors one-on-one and address any concerns they might have with a peer.

We were able to use this experience to educate our tenants about the harms of second-hand smoke and about their right to live free from breathing unwanted smoke from their neighbors. The education process allowed tenants to feel heard and consulted about the policy change, and helped them understand our motivations.

The change to a new policy on Jan. 1 became a collaborative effort with all parties involved in creating a healthier community environment.

Creating smoke-free housing can not only yield happier and healthier tenants, but also produce a significant return to property owners. According to the National Center for Healthy Housing, costs can be anywhere from two to seven times greater when turning over units where smoking is allowed versus smoke-free units.

FAME anticipates substantial savings through lower costs for maintaining and remediating units for new tenants as well as reducing its potential liability, risk of residential fires, tenant conflicts and even insurance premiums

Our experience has been overwhelmingly positive. FAME Housing Portfolio Manager Carmen Buenrostro reports receiving many compliments from tenants on their new living environment.

“There is a tremendous change in the culture of the apartment buildings and people who smoke have been respectful of the policy,” Buenrostro said. “There is less maintenance, less conflict and better communication between tenants and managers.”

In follow-up focus groups with residents, we experienced overwhelming gratitude and welcoming of further tenant education and other supportive measures to ensure the success of our smoke-free initiative. This process has strengthened our tenant communities and is reinforced by CEO Denise Brown’s priority of creating safe, healthy homes for our residents.

“Those who claim smoking restrictions interfere with their personal liberties often haven’t considered the negative health impacts smoking has on those around them,” she noted. “Smoking restrictions are less about infringements on one’s right to smoke, but more about a public health concern. It’s about protecting people from the adverse health effects and consequences resulting from unwanted secondhand smoke exposure. In that respect, non-smokers have a right to be protected.”

That’s why FAME is proud to partner with UCLA in efforts to improve public health among vulnerable populations in Los Angeles, Brown said.

“Secondhand smoke can negatively impact entire communities,” she explained. “This is why this project’s success is so important to us.”

In the last five years, Santa Monica, Glendale, Compton, Pasadena, El Monte, Manhattan Beach, and Culver City have implemented smoking bans for common areas of residential complexes or in private apartment and condominium units.

“The city of Los Angeles is sort of the donut hole,” Toy said. But that could soon change.

“I think what will happen eventually is all apartments and all condominiums will be smoke free,” said Esther Schiller, executive director of Smokefree Air for Everyone, noting the impact of increased funding for educational campaigns from the state’s Department of Public Health, the CDC, and the American Lung Association.

Smoking bans have gained traction over time. A statewide smoke-free ban in workplaces and public spaces took effect in 1995, while restaurants and bars became smoke free three years later − a move which seemed unthinkable back then.
“All of us who worked on all of these things were astounded,” said Schiller, who has been involved with the issue for almost 25 years.

Recent developments, however, seem promising for advocates in favor of a ban, especially as landlords come around to the idea.
Fame’s Brown estimated that the smoking ban would save the company an estimated $5,000 to $15,000 on fire and building insurance a year, in addition to tens of thousands of dollars on lost occupancy dollars and capital from cleaning units that had been occupied by smokers.

“I think it’s beneficial for the landlords,” said Joe Rudeas, who implemented a smoking ban at both a 17-unit property he owns in Hanover Park and a 34-unit property in North Hollywood. The result was a savings of thousands of dollars from not paying cleaning fees to get rid of cigarette odors.

Residents of FAME Housing’s apartment complexes now enjoy smoke-free air thanks to the efforts of FAME’s Tobacco Team and the Residential Voluntary Smoking Reduction Program. As of January 1st of 2022, all FAME properties have adopted and implemented smoke-free policies requiring all outdoor common areas (e.g., open spaces, playgrounds, swimming pool areas, entrances) and 100% of contiguous individual units (including balconies & patios) to be designated as smoke-free. The new policy will greatly reduce exposure to secondhand smoke and will increase air quality in public spaces.

The Residential Voluntary Smoking Reduction Program at FAME Corporations is grant-funded by the California Tobacco Control Program (CTCP) to reduce exposure to secondhand smoke, tobacco smoke residue, tobacco smoke waste, and other tobacco smoke products. The program works with residents and community stakeholders who want to live free from unwanted exposure to secondhand tobacco smoke. Under this program FAME Tobacco staffers Joshua Brindle and Jazmine Guillen worked collaboratively with the apartment communities and FAME Housing management on the implementation of the proposed policy by conducting resident surveys and focus groups, community presentations, distributing factsheets and pamphlets, and providing information at FAME Housing community events.

The objective of the FAME Tobacco Team was to convert six multi-unit housing complexes over the course of the two year grant period. But thanks to the Tobacco Team’s diligent efforts, they achieved double that number and will have converted twelve complexes, including those of FAME Housing.

FAME Corporations is proud of the work undertaken between the housing communities and the FAME Tobacco Team to provide cleaner, healthier air for our residents.

The agency unveiled a long-awaited rule that would give it power to oversee the increasingly popular devices, much in the way that it regulates traditional cigarettes.

“It’s a huge change,” FDA Commissioner Margaret Hamburg told reporters in a briefing Wednesday, before the official announcement of the agency’s plans. “We will have the authority as a science-based regulatory agency to take critical actions to promote and protect the health of the public.”

The proposal will be subject to public comment and further review by the agency before becoming final. But once that happens the rule would impose new restrictions, including:

• A ban on the sale of e-cigarettes to minors.
• A prohibition on distributing free samples.
• A ban on selling e-cigarettes in vending machines unless they are in places that never admit young people.
• A requirement that e-cigarettes carry warnings that they contain nicotine, which is addictive.
• E-cigarette manufacturers would be required to disclose the ingredients in their products.

E-cigarettes are plastic or metal tubes about the size of a traditional cigarette that heat a liquid solution containing nicotine. That creates a vapor that users inhale. Their popularity has soared in recent years.

Some have welcomed the trend as a way to prevent people from smoking traditional cigarettes, which are far more dangerous, and to help smokers quit.

Others fear the devices will addict nonsmokers to nicotine and eventually lead to more people smoking. That has fueled calls for the FDA to assert its authority over the devices. Although e-cigarettes are generally considered much safer than traditional cigarettes, some fear that not enough research has been done to know what risks they may have.

“We call the current marketplace for e-cigarettes the Wild Wild West,” said Mitchell Zeller, who heads the FDA’s Center for Tobacco Products. “We will be in a position to ensure that the products are as safe as they could possibly be.”

The FDA had previously attempted to regulate e-cigarettes, but that effort was thwarted in court. The agency recently signaled, however, that it planned to try again. Thursday’s announcement will make that official.

Some employees say e-cigarettes increase their productivity and help them steer clear of tobacco. But health regulators are looking into possible risks to e-cig users — and to co-workers.

The proposal would also require any new e-cigarettes to get FDA approval before being sold, and demand that current products provide a justification for remaining on the market.

The announcement stopped short of more aggressive regulation that some critics had called for, including restricting or banning fruit flavors and other sweeteners that may appeal to young people.

It also won’t restrict television advertising and online sales, as some had hoped. But Zeller and Hamburg said Thursday’s move is the first step that could lead to such measures if the agency determines that those are needed.

“This announcement starts the process that will give us the authority to actually get out there and regulate e-cigarettes,” Hamburg said.

The FDA also is proposing regulation of a variety of other tobacco-related products, including cigars, nicotine gels, pipe tobacco and water pipes.

E-cigarette companies and anti-smoking advocates had just started to review the FDA’s proposal. But at least initially the industry welcomed the FDA’s plans, apparently relieved the agency had not gone further.

“We are extremely relieved that all e-cigarette companies will be regulated, and forced to achieve and maintain the same high standards that Vapor Corp., and several of our responsible competitors, have been imposing on ourselves for years,” said Jeffrey Holman, president and director of the Dania, Fla., company said in an email to Shots.

Public health advocates generally welcomed the move as an important first step, but expressed disappointment that the agency had failed to regulate the devices more aggressively right away.

“This action is long overdue,” said Matthew Myers, president of the Campaign for Tobacco-Free Kids. “It is inexcusable that it has taken the FDA and the administration so long to act. This delay has had serious health consequences as these unregulated tobacco products have been marketed using tactics and sweet flavors that appeal to kids.”

While some worry about tempting kids with an addictive habit, e-cigs can also be deadly for them.

On Thursday, the CDC released a report indicating a “dramatic” rise in e-cigarette-related calls to U.S. poison centers, from one call a month in September 2010 to 215 calls a month in February 2014. More than half of the calls involved children age five and under, while 42% involved people ages 20 and older. The nicotine in e-cigarette comes in a liquid form, which when ingested can lead to vomiting, nausea, and eye irritation.

“E-cigarette liquids as currently sold are a threat to small children because they are not required to be childproof,” said CDC director Dr. Tom Frieden in a statement. “Use of these products is skyrocketing and these poisonings will continue.”
